Terms & Conditions

Effective date: January 1, 2025

1. Definitions

In these Terms & Conditions, “Main Roads” means Main Roads Western Australia and its contractors, subcontractors, agents, and affiliates, including but not limited to development partners engaged to design, build, or maintain this software (“the Tool”).

2. Acceptance of Terms

By accessing or using the Tool, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Tool.

3. Use of the Tool

The Tool is provided for informational and engineering guidance purposes only. It does not replace professional engineering judgment, and users remain responsible for verifying results and ensuring compliance with all applicable laws and standards.

4. No Warranty

The Tool is provided by Main Roads “as is” without warranties of any kind, whether express or implied, including but not limited to accuracy, reliability, merchantability, or fitness for a particular purpose. Results may contain errors or omissions.

5. Limitation of Liability

To the maximum extent permitted by law, Main Roads shall not be liable for any loss, damage, cost, or expense whatsoever arising out of or in connection with the use of the Tool. This exclusion of liability applies regardless of the cause of action, including (but not limited to) negligence, misrepresentation, breach of duty, or otherwise, whether alleged or proven.

Without limiting the generality of the foregoing, Main Roads shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including (but not limited to) interruption of service, loss of data, loss of business information, loss of revenue, loss of anticipated profits, overpayment of taxes fees or charges, or any other pecuniary or economic loss, even if Main Roads has been advised of the possibility of such damages.

Use of the Tool is entirely at the user’s own risk. The user assumes full responsibility for verifying results and making all engineering and operational decisions based on their own professional judgment.

6. Intellectual Property

All intellectual property rights in the Tool, including the software, design, and associated content, remain the property of Main Roads. The Tool may not be copied, modified, distributed, or reverse engineered without prior written consent from Main Roads.

7. Privacy

The Tool does not require user registration and does not collect personal information. Any optional data entered is processed only for calculation purposes and is not stored or shared by Main Roads.

8. Governing Law

These Terms & Conditions are governed by the laws of Western Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.

9. Changes to Terms

Main Roads may update these Terms & Conditions from time to time. Continued use of the Tool constitutes acceptance of the updated terms.
